Terms & Conditions — Quotation Agreement

1. Acceptance of Terms

By accepting a quote or authorizing Dunsborough Pool & Spa to proceed with residential or commercial services, the client accepts and agrees to be legally bound by these Terms and Conditions.

2. Invoicing, Payment Terms & Automated Billing

· 14-Day Terms: All service invoices carry strict 14-day payment terms starting from the initial date of invoice issue.

· Pinch Payments Pre-Approval: We offer an automated, free pre-authorization service via Pinch Payments. Customers receive a unique registration invitation link via email. Upon setup, invoice totals are automatically transacted securely exactly on their specified due date.

· Failed Transaction Penalty: Pinch will make up to 3 automated collection attempts on an invoice due date. Transactions failing all 3 times will automatically incur a $15 administration account fee.

· Alternative Settlement: Clients opting out of automated processing must manually transfer outstanding balances via Direct Debit bank transfer prior to or on the exact 14-day due date.

3. Special Orders, Equipment Sales & Repair Quotes

· Special Orders & Equipment Deposits: Orders for major capital equipment (including pumps, chlorinator power packs/cells, filtration systems, heaters, and automatic cleaners) as well as any specialized parts sourced via special order require a 50% upfront deposit before parts are ordered. The remaining 50% balance is strictly due immediately upon completion of structural installation.

· 15% Restocking Fee: Any special orders or specialized replacement components cancelled by the customer after processing and order confirmation will incur a mandatory 15% restocking fee to offset vendor freight and administration penalties.

· Quote Validity: All formal technical repair or mechanical upgrade quotes remain valid for 30 days from the initial date of issue.

4. Advanced Quoting Mandate & Site Access

· Advanced Quotes Required: Major stain removals, large-scale component repairs, component plumbing upgrades, and heavy equipment maintenance will be fully assessed and formally quoted to the client before any technical work begins.

· Unexpected Equipment Limitation: If a technician identifies severe structural, mechanical, or hydraulic issues on-site (such as compromised pump suction or compromised pipework) that impede servicing, operational work will stop immediately. The customer will be contacted to review a re-quote.

· Site Access: The client must guarantee unobstructed access to the pool, skimmer boxes, and functional water source points on the scheduled day of service.

5. Non-Payment & Balance Defaults

· Late Payment Interest Fees: Accounts remaining unpaid past the strict 14-day settlement threshold will automatically accrue interest compounding weekly at a rate of 2% per month on all outstanding balances until settled in full.

· Suspension of Recurring Services: Dunsborough Pool & Spa reserves the right to immediately suspend all recurring services, scheduled maintenance, and hardware installations if a customer carries an un-settled balance exceeding 30 days from the initial invoice date. Services will only resume once the outstanding account is brought to a $0 balance.

· Third-Party Collection Costs: In the event that a balance must be referred to an external debt collection agency or legal representative, the client agrees to be fully liable for all third-party collection fees, legal costs, court filing expenses, and administrative penalties incurred during recovery.
